Damien Oliver has won his appeal against a one-month suspension after a random drug test on Derby day showed traces of ephedrine.

Damien had taken some herbal medicine that suppresses appetite.

Ephedrine has only recently been placed on the banned list.

The Judge upheld the appeal and proceeded to give Racing Victoria a serve. He said they obviously had a communication problem that needed to be addressed urgently.

The Judge didn’t miss stewards. He was critical that jockeys were expected to keep abreast of changes of rules by reading a magazine titled “Inside Racing”.

Those who paid $1.8 million to purchase a three-quarter sister to Makybe Diva must be down in the dumps after a mid-week Maiden at Eagle Farm last week.

She paraded beautifully before the race but when they jumped, she missed the start and ended up only beating one home.

Of course her famous three-quarter sister was also a late maturer, but her owners will have to make a decision if she continues to show no form.

At the moment she would be a very valuable brood mare with her foals bringing big money, but every time she fails on the race track their value will decrease.

Knew we were in trouble as they paraded. The sweat was pouring off him.

Missed the kick and was locked behind them, racing erratically until well into the straight, yet could still run on for third.

(Each way showed a small profit). A big baby and green as grass but will win races.

“And she saw me looking at a drunken women. ‘Do you know her?’ she asked.

I said, ‘yes she was my girlfriend before I met you. I’m told after we split up she took to drinking and hasn’t been sober since.’

The missus said, ‘Who would think a person could go on celebrating that long.’”

I read with a great deal of interest the report covering the OLIVER DRUG appeal. It is not generally known that the appeal board is generally headed by an aged retired judge that just loves a punt.TWO YEARS AGO a well know Jockey in NSW received a warning for being in breach of the rules for having a positive test to the SAME DRUG that Oliver returned. Some time later the same hoop was given a MONTH suspension for a 2nd positive.The RVL HAD advised all and sundry that a particular substance is a DRUG within the definition of their rules.Now OLIVER HAS A MANAGER TO CONTROL HIS AFFAIRS. The Jockeys Association, who claims to support all its members, obviously didn't see fit to bring the DRUG PROBLEM to the notice of all their members when its NSW member was suspended two years previously. The Jock's Ass used the old defence of attack is better than defence. They haven't acknowledged any oversight on their part nor that of OLIVER'S MANAGER. No - the 'old punter' attacks the Stewards for penalising a Jock that PLEADS GUILTY to the charge. Ask yourself-would you plead GUILTY to DRUGS if NOT guilty?
